The Game is open exclusively to natural persons who are at least 14 years old, have a residence or domicile in the following European Union countries, possess a valid identity card issued by a country authority, and have their own Mobilredfox webshop profile, who are competent throughout the entire duration of the Game and do not fall into the excluded persons category ("Player"). Participating countries: Hungary, Czech Republic, Poland, Romania, Bulgaria, Greece, Slovenia, Slovakia, Netherlands. Individuals under the age of 18 may only participate in the Game and receive the prize with the consent of their legal representative. Participation in the sweepstakes is possible after downloading the MOBILREDFOX's uniquely developed Mobilfox App and creating an individual profile followed by registration. The prizes won from spins are received by the User in the form of coupons within the profile created in the app. The coupons can be redeemed on the MOBILREDFOX websites that are actively operating in the aforementioned countries with a purchase of 82 PLN, except for the 30% discount coupon. The prize must be selected on the website on the landing page created for this purpose and placed in the cart. After placing the prize in the cart, the User can redeem the coupon, which is only valid for the product; the User must pay the shipping fee. A User can redeem a coupon only once, multiple orders are not accepted by the organizer. The coupon entitling to a discount can be redeemed in conjunction with another promotion and is valid for any MOBILREDFOX product found on the MOBILREDFOX website. The discount is deducted from the cart value, not applicable to shipping costs. We inform you that the car featured in the campaign communications is not part of the prize draw; it is solely a campaign tool and will not be raffled off. The type of car that can be won is a 2008 Porsche Cayenne, or if the winner chooses, a cash amount of equivalent value based on the car's market value in Europe. We inform you that starting participation in the Game implies automatic acceptance of these Game Rules. Participation in the Game does not require purchasing a product on the MOBILREDFOX website in addition to registration. The Game is not considered gambling as defined by the 1991 XXXIV law on the organization of gambling. This Game is not sponsored, endorsed, organized, or collaborated by Apple. The data provided in the Game goes into MOBILREDFOX's database and is used as specified in the Game Rules. Apple does not support the Game in any way or collaborate with it. The participants of the Game are not administered or monitored by Apple. |

The Game is open to anyone who, according to these Game Rules, or and accepts all conditions written in these Game Rules and consents to the handling of their data as specified in these Game Rules. At registration, Users must provide their phone number, email address, full name, gender, date of birth, and type of mobile phone. The application becomes active after using the authentication code received via SMS. After successful login, the User is eligible to spin the "wheel of fortune." The individual prizes are received by the Users in the form of a coupon within the app. The received coupon is valid for 48 hours and must be redeemed within 48 hours through the MOBILREDFOX website. |

The cost of delivering the physical prizes to a pre-agreed address is borne by the Organizer. If the winning User does not use the coupon within 48 hours on the MOBILREDFOX website, the coupon is not valid after 48 hours. MOBILREDFOX excludes from the Game any Player whose Prize cannot be delivered because the personal data provided at registration are not real, incomplete, or incorrect, or if the User otherwise does not meet the personal conditions written in these Game Rules. The Organizer is not responsible for any damage resulting from incorrect data provision by the User. The Organizer reserves the right to change the Game during its duration. The Organizer records that its responsibility extends only to providing the prize; ensuring additional conditions related to the use of the prize is not its obligation. MOBILREDFOX excludes its liability for any circumstances that arise after the prize delivery during its use, or related to it, at the winner or a third party. |

Terms and conditions: |
Those involved in organizing or executing the Game, including MOBILRENDFOX and related organizations, agencies, their owners, executive officers, employees, or those in any other working relationship with them, and their relatives as defined in Section 8:1 (1) clause 2 of the Civil Code, cannot participate in the Game. A person can participate in the Game multiple times, i.e., a User can meet the Participation Conditions multiple times. Participation in the game is voluntary and free of charge. If the winner loses their entitlement to the prize because they do not receive the message due to individual settings of the email program or social media platform, etc., they are not entitled to further complain at MOBILREDFOX, thus MOBILREDFOX excludes its liability for the failure to deliver the prize, which is a consequence of the winner being unreachable for any reason after the Prize has been awarded. If the winner's provided data do not match reality, are incompletely provided, or any other reason exists that does not entitle them to use the prize, MOBILREDFOX is not obliged to deliver the prize again. All other arising costs must be borne by the Winner. MOBILREDFOX excludes its liability for the failure of the application and the website due to external reasons, during which time the application and website are not or are only limitedly usable; however, it will take all necessary measures to investigate and eliminate the cause of the error as soon as possible. MOBILREDFOX excludes its liability for any external attacks on the application and the website, or the server operating them. Thus, if you receive incorrect system messages as a result of an attack on the application and the website, or the server, MOBILREDFOX does not assume any liability in such cases. MOBILREDFOX is not responsible for the availability and operation of telecommunications and information technology equipment, or for the activities of third parties. MOBILREDFOX is not responsible for the incorrect operation of online platforms, which can be traced back to independent causes, especially: the failure or unavailability of the server operating the online platform, lack of internet connection, operational disruptions of the backbone network, failure to connect to the internet platform, or part of it. MOBILREDFOX takes all reasonably expected measures to ensure that participation in the sweepstakes is possible on all widely used types of computers, mobile phones, operating systems, and internet browsers, however, it does not guarantee and is not responsible for how effectively you can use the various systems during participation in the sweepstakes. Participation in the Game with a profile registered by a third party is an absolute condition of exclusion. If the User does not use their own registered customer profile, they are automatically excluded from the Game. MOBILREDFOX excludes all its liability related to disputes arising from the right to use the customer profile associated with the Game. Users are identified in the Game based on their Mobilredfox website account name. The Organizer is not responsible for any technical problems arising from changes in the data, especially the deletion or unavailability of the customer profile, outside the Organizer's sphere of interest. By participating in the game, Users accept the principles of impartial and moderated communication. MOBILREDFOX does not wish to engage in negative communication regarding the Game or MOBILREDFOX. Questions and complaints related to the game or game organization should be addressed to info@mobilfox.com via message. The data provided in the Game go into the MOBILREDFOX database and are used as specified in the Game Rules. MOBILREDFOX reserves the right to unilaterally modify, suspend, or terminate the conditions contained in these Game Rules or the Game itself - even during its duration. MOBILREDFOX is entitled to exclude any player from the Game, especially if there is suspicion of abuse or breach of conditions related to the Game, or if any player manipulates the course of the Game in any way or acts in bad faith. Notifications of amendments to these Game Rules or the possible suspension or termination of the Game will be published by MOBILREDFOX on the https://hu.mobilfox.com/pages/aszf page. The Organizer automatically excludes participants who provide unreal data from the Game. The Organizer may examine the Users to ensure compliance with the conditions of the Game Rules, and if they do not meet any of the conditions for any reason, the affected User may be excluded from the Game. There is no further legal dispute regarding the exclusion. Users who participate in the Game with unreal data may be excluded from the Game based on the Organizer's assessment. Participants or Users who exhibit dishonest behavior as specified in this section are obliged to compensate for any damage caused to the Organizer in connection with the Game. MOBILREDFOX reserves the right to immediately exclude a Player from the Game if it observes or has a well-founded suspicion of any (computer) manipulation, mass generation of profiles, or behavior incompatible with or violating the spirit of the Game by any User. The Organizer is not responsible for any failure or delay in the delivery of the Prize, or for any damages incurred during delivery. If the winner does not collect their Prize at the time agreed with the courier service or the Organizer, they cannot subsequently demand it from the Organizer. The current Game and Game Rules are governed by Hungarian law. Taxation MOBILREDFOX does not assume any taxes and contributions that may arise in connection with the receipt of the Subject Prize. MOBILREDFOX undertakes to pay any taxes and contributions that may arise in connection with the car, based on the personal data provided by the winner, but does not cover costs such as the cost of transferring ownership to the winning Player; these costs are borne by the winning Player. |
PRIVACY NOTICE
By accepting the Conditions, you expressly consent, with adequate information, that your data be handled and stored by MOBILREDFOX as the data controller, under Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, repealing Directive 95/46/EC (hereinafter: GDPR), and in accordance with all relevant legal provisions in force, for the duration necessary for participation and communication in the Sweepstakes, or until the withdrawal of consent.

Legal basis for data processing
We inform you that the Players' data is handled by MOBILREDFOX based on the consent of the players under Article 6(1)(a) of the GDPR, and the data of the selected winners in the Game is handled by MOBILREDFOX under Article 6(1)(b) of the GDPR on the basis of contract performance for the delivery of prizes and the fulfillment of the gift contract.
Scope of managed data and duration of data processing
During the organization of the Sweepstakes and the sending of prizes, MOBILREDFOX handles the following data:
For all players: Name, Email address, Phone number, Gender, Date of birth, Type of mobile phone device
For winners: Name, Email address, Phone number, Gender, Date of birth, Type of mobile phone device
Duration of data management: 5 years after the closure of the Game according to the general statute of limitations of the Civil Code. Financial data generated in connection with the Prize, which qualifies as an accounting document, is handled by MOBILREDFOX for at least 8 years according to § 169(2) of the Accounting Act of 2000.
If we handle your data based on your consent, you may withdraw your consent statement at any time without restriction, condition, and justification by sending an email to info@mobilfox.com. Following the withdrawal of your consent, MOBILREDFOX will immediately delete your managed data.
Automated decision-making (including profiling): There is no automated decision-making, including profiling, during the data processing.
Recipients of personal data and categories of recipients: Personal data is not transferred to third countries (i.e., outside the European Union) or international organizations.
Data security: The data controller takes all necessary measures to ensure that the data is not accidentally damaged or destroyed. However, the Instagram platform is responsible for the security of data stored on Instagram servers, and their data protection policy is applicable to their data processing.
Rights of the data subject: The rights and remedies available to the Player regarding data protection, as well as their limitations, are detailed in the GDPR (particularly Articles 15, 16, 17, 18, 19, 20, 21, 22, 77, 78, 79, and 82). The following are the key provisions summarized:
Right to information: If the Data Controller processes personal data concerning the Player, the Data Controller is obliged to provide the Player with information about the essential characteristics of the data processing, including the purpose, legal basis, duration, the identity and contact details of the Data Controller and its representative, recipients of the personal data, and the rights and remedies available to the Player regarding data processing (including the right to lodge a complaint with the supervisory authority). The Data Controller provides this information by making this statement available to the Player.
Right of access: The Player has the right to obtain confirmation from the Data Controller as to whether or not personal data concerning them is being processed, and if such processing is taking place, to access the personal data and certain information related to the data processing. This includes the purposes of the data processing, categories of personal data processed, recipients of the personal data, the (planned) duration of the data processing, the rights and remedies available to the data subject (including the right to lodge a complaint with the supervisory authority), and information about the sources of the data when collected from the data subject. Upon request, the Data Controller shall provide the Player with a copy of the personal data undergoing processing. For any further copies requested by the Player, the Data Controller may charge a reasonable fee based on administrative costs. The right to obtain a copy should not adversely affect the rights and freedoms of others. The Data Controller shall provide information about the possibility, method, possible costs, and other details regarding the provision of a copy upon request by the Player.
Right to rectification: The Player has the right to request the Data Controller to rectify any inaccurate personal data concerning them without undue delay. Taking into account the purposes of the data processing, the Player is entitled to request the completion of incomplete personal data, including through a supplementary statement.
Right to erasure: The Player has the right to request the Data Controller to erase personal data concerning them without undue delay, and the Data Controller is obliged to erase such personal data without undue delay if certain conditions are met. Among others, the Data Controller shall erase the personal data upon the Player's request if the personal data is no longer necessary for the purposes for which it was collected or otherwise processed, if the Player withdraws their consent on which the processing is based and there is no other legal ground for the processing, if the personal data has been unlawfully processed, or if the Player objects to the processing and there are no overriding legitimate grounds for the processing, or if the personal data has to be erased for compliance with a legal obligation applicable to the Data Controller, or if the personal data has been collected in relation to the offer of information society services.
If the data processing is based on the Player's consent, the consequence of withdrawing consent is that the Player will no longer use the application, as consent is given by selecting the specific function and using the application.
Please note that the withdrawal of the Player's consent does not affect the lawfulness of the processing based on the consent before its withdrawal.
The right to restrict data processing: The Player is entitled to request the Data Controller to restrict the processing of data if one of the following conditions is met:
- a) The Player disputes the accuracy of the personal data, in which case the restriction applies for a period that allows the Data Controller to verify the accuracy of the personal data; b) The processing is unlawful, and the Player opposes the erasure of the data and instead requests the restriction of their use; c) The Data Controller no longer needs the personal data for the purposes of processing, but the Player requires them for the submission, enforcement, or defense of legal claims.
If data processing falls under the aforementioned restrictions, such personal data, except for storage, may only be processed with the Player's consent or for the submission, enforcement, or defense of legal claims, or for the protection of the rights of another natural or legal person, or for important public interest of the Union or a Member State.
In case of lifting the restriction on data processing, the Data Controller will inform the Player in advance.
Right to Data Portability: The Player is entitled to receive the personal data concerning them, which they have provided to the Data Controller, in a structured, commonly used, machine-readable format, and they have the right to transmit those data to another data controller without hindrance from the Data Controller to whom the personal data have been provided if:
- a) the processing is based on the Player's consent or on a contract in which the Player is a party; and b) the processing is carried out by automated means.
When exercising the right to data portability, the Player has the right to request, if technically feasible, the direct transfer of personal data between data controllers.
The right to data portability shall not adversely affect the right to erasure and shall not adversely affect the rights and freedoms of others.
Legal Remedies:
The Data Controller makes every effort to ensure that the processing of personal data complies with the applicable laws. If the data subject feels that the data controllers have not complied with this, they can submit their comments to the email address info@mobilfox.com or to the postal address Mobilredfox Office, 4th Floor, 2 Dalszínház Street, Budapest 1061. If the data subject believes that their right to the protection of personal data has been violated in accordance with the relevant laws, they may seek legal remedies with the competent authorities: the National Authority for Data Protection and Freedom of Information (1055 Budapest, Falk Miksa utca 9-11.) or a court. The data subjects' legal remedies include, among others, the provisions of the GDPR. Data subjects may request information about the processing of their personal data at any time, which the data controller can only deny in exceptional cases in accordance with the relevant laws. In the event of a refusal to provide information, the data controller shall communicate in writing the legal basis for the denial of information. If the data subject turns to a court in case of a violation of their rights, the court shall handle the case promptly. The jurisdiction of the court is determined by the relevant law, but the lawsuit can also be initiated before the court of the data subject's domicile or habitual residence, according to the Player's choice. The data controller has the burden of proof to demonstrate compliance with the provisions of the law regarding data processing. If the data controller causes damage to another person through the unlawful processing of the data subject's data or by breaching the requirements of data security, they are obliged to compensate for the damage. If the data controller violates the data subject's right to personality through the unlawful processing of the data subject's data or by breaching the requirements of data security, the data subject may claim compensation for damages. The data controller is relieved of liability for the damage caused and the obligation to pay compensation if they can prove that the damage or the violation of the data subject's right to personality was caused by an unavoidable circumstance beyond the scope of data processing. No compensation for damage is required and no claim for damages can be made to the extent that the damage or violation of the right to personality was a result of intentional or grossly negligent behavior on the part of the Player.
