Mobilfox Content Creator Program
General Terms and Conditions (GTC)
1. Introduction, Purpose of the Policy
These General Terms and Conditions (hereinafter: “GTC”) set forth the rights and obligations of natural persons (hereinafter: “Content Creator”) participating in the Mobilredfox Content Creator & Affiliate Program (hereinafter: the “Program”) operated by Mobilredfox Limited Liability Company (registered office: H-3300 Eger, Kistályai út 5., Hungary; hereinafter: “Mobilredfox” or “Service Provider”).
The purpose of the Program is for Content Creators to promote Mobilredfox products through their own authentic social media content, in return for which they may receive the benefits and commissions specified in these GTC, subject to compliance with the stipulated conditions.
Participation in the Program is subject to registration. By registering, the Content Creator expressly accepts these GTC.
During the cooperation, the Content Creator is obliged to provide their own true and accurate personal data. If false data or data attributable to another person is provided during the cooperation, the resulting Agreement shall be null and void. Mobilredfox excludes all liability if the Content Creator participates in the Program in the name of another person or using another person’s data.
2. Elements of the Program
2.1. Gift Voucher
Following registration, the Content Creator shall receive a unique gift voucher with a face value of HUF 100,000, which can be used in the Mobilredfox webshop.
2.2. Affiliate Tools
The Content Creator shall receive a unique affiliate link and coupon code, entitling them to commissions on purchases made through their use, in accordance with the specified conditions.
2.3. Commission System
In the Program, Content Creators will be assigned an active/inactive status, which will be reviewed by Mobilredfox Ltd. at the beginning of each month based on the performance of the previous month. The month of joining does not count as fulfillment. For example, if the Content Creator joins on February 15, the first review will take place at the beginning of April. During the first review, the Content Creator will receive prior notice regarding whether they have met or not met the Program's conditions for the previous month. However, their status will remain unchanged at this stage, and commission will be calculated according to the commission rates for the active status. If the content requirement is not met in the following month, their status will change to inactive, and commission will be calculated according to the conditions for the inactive status.
Active Status:
-
Minimum 2 TikTok videos per month, recommended to share as your own Reel or Instagram Story.

The videos must also be submitted for advertising purposes by Mobilredfox Ltd., and they can be used on all platforms.
Commission: 2,000 HUF per sale,
For special promotional periods, the commission: 1,000 HUF per sale (with separate notification).
Inactive Status:
-
If the monthly content requirement is not met.
Commission: 500 HUF per sale,
After 60 days of continuous inactivity, the account will be closed, and no commission will be paid.
2.4. Payment Method
The performance will be reviewed over a 30-day period, so if the content creation starts on February 15, the first month will end on March 15. After that, a 30-day maintenance period begins, during which Mobilredfox checks for any potential fraud and verifies that all purchases came through the correct affiliate link. Once this review is completed, payment for the approved items will be initiated, with an approximate processing time of two weeks.
Commissions will be paid automatically to the Content Creator's provided bank account after the performance review.

3. Gift Voucher Order Process
3.1. The Content Creator shall receive feedback from Mobilredfox by e-mail within 48 hours following the submission of the order. This feedback shall, on the one hand, confirm that the Content Creator’s order has been received by Mobilredfox and, on the other hand, indicate whether Mobilredfox accepts and confirms the order or rejects it. If Mobilredfox expressly accepts the order in its feedback sent within 48 hours, it shall also provide the Content Creator with the details of the order in such feedback. The legal relationship between the Parties concerning the dispatch of the Gift Package shall be established upon the acceptance statement communicated in the feedback.
3.2. If the Product intended to be ordered is not available at the time the order is placed, or the Product cannot be procured within the time period indicated on the Website, or the order cannot be fulfilled for any other reason, Mobilredfox reserves the right not to accept the order for the Product. In such case, the Content Creator shall likewise be notified in the feedback within 48 hours following submission of the order.
3.3. Mobilredfox informs the Content Creator that if the Service Provider expressly accepts the Content Creator’s order in its feedback pursuant to Section 3.1, the contract between the Parties regarding the subject matter of the order shall be concluded. If, during the finalization of the order, the Content Creator provided an incorrect, erroneous, or incomplete e-mail address and Mobilredfox becomes aware of this in the form of an error message when sending the feedback containing the acceptance statement, the Service Provider’s customer service shall immediately contact the Content Creator by telephone to verify the data, after which Mobilredfox shall resend the feedback containing the acceptance statement to the corrected e-mail address. Such acceptance statement shall be deemed by the Parties to have been made within the applicable deadline.
3.4. If, with respect to contracts already concluded, a change occurs that affects material information relating to the delivery deadline of the Product (e.g., the delivery deadline has been extended), Mobilredfox reserves the right to modify the contract with respect to the delivery deadline for duly justified reasons related to disruptions in international supply chains. In such cases, Mobilredfox shall immediately inform the Content Creator of the new delivery deadline upon becoming aware of the change. In such cases, the Content Creator shall have the right of withdrawal, of which Mobilredfox shall notify them by e-mail. If the Content Creator does not wish to exercise the right of withdrawal, Mobilredfox shall deliver the Product to the Content Creator based on the modified data.
3.5. Personal collection of the ordered Product at Mobilredfox’s premises is not possible.
3.6. All additional terms and conditions related to the order are set forth in the General Terms and Conditions published on the website hu.mobilfox.com. The General Terms and Conditions specified therein shall also become applicable to the Content Creator upon placement of the order.
4. Content Creation Obligations
4.1. Use of the Gift Voucher
If the Content Creator uses the gift voucher to make a purchase for their own benefit, they are obliged to publish content created as a result of such purchase on their own social media platform (e.g., TikTok, Instagram, YouTube).
4.2. Nature of the Content
The published content must:

be authentic and created by the Content Creator,
-
actually present a Mobilredfox product,
-
not contain false, misleading, or exaggerated statements,
-
not harm Mobilredfox’s reputation, business interests, or brand values.
4.3. Failure to Publish
If the Content Creator fails to comply with the obligation set out in Section 4.1, Mobilredfox shall be entitled to:

withhold payment of commissions,
-
reclaim the full face value of the gift voucher,
-
immediately exclude the Content Creator from the Program,
-
terminate all cooperation with the Content Creator.
Failure to publish the content shall constitute a material breach of contract.
5. Prohibited Conduct
The following actions by the Content Creator are strictly prohibited, in particular:
-
making purchases in bad faith for themselves or for a relative for the purpose of obtaining commissions,
-
generating fake accounts, bots, or artificial traffic,
-
communicating misleading or false marketing claims,
-
misuse of the Mobilredfox brand name, logo, or products,
-
discrediting Mobilredfox’s competitors in a false or misleading manner for the benefit of Mobilredfox,
-
conduct that violates applicable laws or these GTC,
-
publishing the unique affiliate link or coupon code on coupon, cashback, deal, promotion-aggregation or similar websites, applications, forums, or in closed or public coupon groups, including in particular automatic coupon aggregator systems,
-
distributing the coupon code or affiliate link in a manner not connected to the Content Creator’s own genuine audience,
-
launching paid advertisements targeting the Mobilredfox brand name, trademark, domain, or misspellings thereof (brand bidding), including search advertisements and marketplace campaigns, without the prior written consent of Mobilredfox,
-
using cookie stuffing, forced clicks, link hijacking, or any technical manipulation to artificially increase commissions,
-
distributing the coupon code in an environment associated with unlawful, offensive, hateful, pornographic, political, or otherwise brand-incompatible content with Mobilredfox’s brand values,
-
circumventing the conditions of the Program by registering multiple accounts, involving straw persons, or using any similar arrangement,
-
presenting the coupon code as a price discount in a manner that misleads consumers (e.g., advertising or communicating a promotion under the Mobilfox name that is not official, without specific authorization),
-
conducting marketing activities within the framework of the Program that violate the rules or policies of the relevant platform (e.g., TikTok, Instagram, YouTube, Google, etc.).
6. Fraud and Legal Consequences
6.1. Suspicion of Fraud
If Mobilredfox detects circumstances indicating fraud, abuse, or bad-faith conduct, it shall be entitled to:
-
temporarily or permanently withhold payment of commissions,
-
immediately exclude the Content Creator from the Program,
-
demand repayment of the gift voucher and any unlawfully obtained commissions.
6.2. Compensation for Damages
In the event of bad-faith fraud, the Content Creator shall be obliged to repay to Mobilredfox the unlawfully obtained amount and compensate Mobilredfox for all damages incurred. The obligation to compensate for damages shall extend in particular, but not limited to, reputational damage, legal representation fees and procedural costs incurred in connection with legal proceedings, as well as any other provable direct or indirect damages.
The obligation to compensate for damages under this Section shall not be limited to cases of bad-faith fraud but shall also extend to all damages and legal consequences arising from the violation of any of the prohibited conduct specified in Section 5. A breach of the provisions set out in Section 5 may in itself give rise to a claim for damages.
7. Withholding of Payments
Mobilredfox shall be entitled to withhold the payment of commissions until:

the legality of the disputed transactions has been clarified,
-
the Content Creator has provided the necessary information or evidence,
-
suspicion of fraud or abuse no longer exists.
8. Use of Content
8.1. By participating in the Program, the Content Creator consents to Mobilredfox using the content created by them free of charge on its own marketing channels (e.g., social media advertisements), subject to compliance with applicable copyright laws.
8.2. By accepting these Contractual Terms, the Content Creator declares that the economic copyrights in the content created during the performance of the Services (hereinafter: “Content”) — in consideration of the payment of the commission specified in Section 2.3 — shall vest exclusively in Mobilredfox from the time of payment and shall be transferred to Mobilredfox.
8.3. To avoid any doubt, the Parties record that all intellectual creations produced by the Content Creator for Mobilredfox in the course of or in connection with the performance of this Program (including, in particular but not limited to, Content qualifying as works protected by copyright and/or related rights) shall be subject to the exclusive economic and exploitation rights of Mobilredfox. The Content Creator may exercise their moral rights in good faith and shall refrain from exercising such rights in a manner that could adversely affect the interests of Mobilredfox. With respect to intellectual creations for which economic copyrights are transferable, following payment of the commission specified in Section 2.3, the Content Creator grants Mobilredfox an exclusive, full, and unrestricted right of use and exploitation (without limitation in time or territory), which also excludes any further use or exploitation by the Content Creator, except where such use serves the interests of Mobilredfox. Mobilredfox may exercise this right of use independently of the subject-matter and temporal scope of this Agreement, without limitation and without any obligation to pay additional remuneration. The Commission has been determined taking this provision into account; the Parties agree on its amount with this understanding and expressly acknowledge it as proportionate. Accordingly, Mobilredfox shall under no circumstances be obliged to make any further payments on this legal basis, nor may any additional claims be asserted against Mobilredfox in this regard. For the purposes of this paragraph, intellectual creations shall include, in particular but not limited to, computer programs, algorithms, industrial property creations, inventions and patents, utility models and design protections, trademarks, know-how, as well as all works falling within the scope of Act LXXVI of 1999 on Copyright and the Hungarian Civil Code.
8.4. The Parties record that, in view of the above, upon payment of the Commission Mobilredfox acquires the economic rights in the Content and its constituent elements, or, where transfer is not possible, the exclusive right of use thereof. Accordingly, Mobilredfox shall be entitled — without any further consideration or limitation (including, in particular, territorial, temporal, modal, quantitative, or technical limitations) — to use any part or element of the Content for its own purposes, including advertising, by any technical means, on any platform, at its discretion; to alter, modify, or process the Content; to sell or transfer these rights of use to third parties; or otherwise exploit the Content. The Content Creator shall not be entitled to any further use or exploitation of the Content, may not grant any further licenses in respect thereof, and may not use the Content.
8.5. The Content Creator declares that there is no legal obstacle to Mobilredfox’s use, under this Agreement, of any works, intellectual creations, or Content provided to Mobilredfox in connection with the performance of the Content specified in this Agreement that are protected by copyright, trademark, or other intellectual property rights, meaning that no third party holds rights that would hinder or prevent the intended exploitation of such intellectual creations.
8.6. The Content Creator declares and warrants that they are the rights holder of any works protected by copyright or related rights used in the creation of the Content, or that they have obtained the necessary authorization from the relevant rights holder(s) for the use specified in this Agreement. Consequently, the materials provided to Mobilredfox do not infringe any copyright or related rights of third parties. If the creation of the Content involves the adaptation, transformation, or use of any protected work, the Content Creator undertakes to obtain, in advance, any permissions required under applicable copyright laws from the relevant rights holder(s) for such use and for the use specified in this Agreement. Should any third party assert a claim against Mobilredfox on the grounds of copyright infringement in relation to the Content, the Content Creator undertakes to assume full liability in place of Mobilredfox and to fully indemnify Mobilredfox.
8.7. The Parties record that graphic elements, logos, trademarks, and products provided by Mobilredfox to the Content Creator may be used solely in a manner and for purposes consistent with this Agreement; any other use shall be unlawful. The Content Creator shall be liable for any damages arising from unlawful use or resulting therefrom. The Content Creator expressly acknowledges that if the logos or products provided by Mobilredfox are used for purposes other than the performance of the tasks specified in this Agreement or the creation of the Content, this shall constitute a material breach of contract and may result in immediate termination of the Agreement by Mobilredfox.
9. Termination of the Program
Mobilredfox shall be entitled to modify or terminate the Program or these GTC at any time without providing reasons. Any modifications shall enter into force upon publication.
10. Top-Performing Content Creator
10.1. Mobilredfox shall be entitled to award, as a reward, one (1) iPhone 17 Pro per month to the Content Creator who, in the relevant calendar month, qualifies as the top-performing Content Creator under the Program based on Mobilredfox’s criteria.
10.2. The determination of the “top-performing Content Creator” shall be at the sole discretion of Mobilredfox, taking into account, in particular but not limited to, the following factors:

the number and value of successful purchases made through the affiliate link or coupon code,
-
the quality, reach, and engagement metrics of the created content,
-
compliance with Mobilredfox’s brand values and communication guidelines,
-
active and good-faith participation in the Program.
10.3. The reward shall not be considered a guaranteed benefit; the Content Creator shall not acquire any entitlement to it, and its award is not automatic.
10.5. Mobilredfox reserves the right not to award a reward in any given month, in particular in cases of low activity, insufficient performance, or suspicion of abuse.
10.6. The reward may only be granted to a Content Creator who:

fully complies with these GTC,
-
is not under suspicion of fraud, abuse, or bad-faith conduct,
-
does not damage the reputation of the Mobilredfox brand.
10.7. Mobilredfox shall be entitled to modify the type, conditions, or frequency of the reward, or to partially or entirely discontinue the reward system, without prior notice.
11. Miscellaneous Provisions
Matters not regulated in these GTC shall be governed by the applicable Hungarian laws, in particular the provisions of the Civil Code.
The Parties expressly agree that electronic correspondence (e-mail) constitutes official communication between the Parties. The long-term storage of transmitted information shall be the responsibility of both Parties. Mobilredfox shall not be liable for any damages resulting from changes to the Content Creator’s e-mail address or any other technical malfunctions. The Content Creator shall, as soon as reasonably possible, notify Mobilredfox of such changes or operational malfunctions.
The Parties shall first attempt to resolve any disputes between them amicably.
